Mediation typically follows a basic format:
Either one member of the party, or both will contact the office to set an appointment. Both parties come to the first appointment.
The mediator then meets with the parties generally together, or in separate rooms if desired, to provide an overview of the process, determine the issues that need to resolved, and to discuss the various ways of resolving those issues. The mediator also discusses payment of bills, access to children, if any, and other issues that need to be addressed.
The next step involves gathering information and documents so that the mediator and parties have full knowledge of all assets, debts, and options for their children, if any. The gathering information phase can be as simple as having a party print out bank statements and bring in tax returns, or as complex has hiring an outside business appraiser to determine the value of a business.
Once the “gathering information” phase is completed, the mediator meets with the parties to put together a final agreement on all issues.
